2010 Golf Digest Armchair Architect Competition: Complete Rules

The following are the official rules for Golf Digest Armchair Architect Competition (The Competition).
Sponsor: The Competition is sponsored by Golf Digest Publications, 20 Westport Rd., Wilton, CT 06897.
Binding Agreement: In order to enter the Competition, each entrant ("you") must agree to these Official Rules, which consist of these terms and conditions. You must have access to the Internet and a valid e-mail address in order to enter the Competition.
Eligibility: The Competition is open to amateur designers (individuals who have not sold a golf course design or been paid for designing golf holes or courses in the past) who are legal residents of the 50 United States, the District of Columbia or Canada (except the Canadian Province of Quebec) who are 13 years of age or older as of the date of entry. Anyone between the ages of 13 to 17 must obtain the permission of a parent or legal guardian prior to entering, and the parent or guardian must consent to be bound -- on their child's and their own behalf -- to these Official Rules. The Competition is subject to all applicable federal, state and local laws and regulations, and is void in the Canadian Province of Quebec, outside the 50 United States/DC and Canada, and where otherwise prohibited. Employees of Sponsor -- as well as their immediate families (spouse, parent, sibling, child, and spouse of any of the foregoing) and those living in their immediate households, whether or not related -- are not eligible to enter the Competition or to win a prize.
Entry Period: The Competition entry period begins June 5, 2010 at 9:00 am EDT and ends on August 15, 2010 at 5:00 pm EDT (the "Entry Period"). Competition Details: Competition is divided into two parts: 1) Using Google Earth to find the next great place to build a golf course; and 2) Using Google SketchUp or other methods to create a design for one hole on the site keeping in mind the geographic location of your new course. Create the hole using Google SketchUp or another 3D modeling program, and place the model on a specific location in Google Earth and in the Google 3D Warehouse. You may also use other media and formats. Designs created in other media should be sent to: Armchair Architect Competition, Golf Digest, 20 Westport Rd., Wilton, CT 06897.
How to Enter: Complete the entry form and enter all required information as indicated with an asterisk below (unmarked items are optional). Entries must be submitted on golfdigest.com or mailed to Golf Digest, 20 Westport Rd., Wilton, CT 06897. All images and text submitted become the property of Golf Digest and will not be acknowledged or returned. Entries must be submitted during the Entry Period to be considered.

* You have the ability to upload up to three (3) still images and one (1) animation of your hole. Although only one (1) still image is required, the additional views may be helpful in giving a sense of the space in and around your hole.
• A written description (no more than 150 words) of your site and hole is required and will help the jury (as well as visitors to the Competition website) understand your thought process and your design.*
All entries must be in English. Entries using Google SketchUp must be uploaded into the Google 3D Warehouse. To upload your model to the 3D Warehouse you must create a Google Account. There is no charge to create an account. To sign up for a Google Account, visit google.com/accounts. Sponsor accepts no responsibility for lost or delayed submissions. The submission of an entry is your sole responsibility. Automated entries (including, but not limited to, entries submitted using any bot, script, macro or contest service), copies, third-party entries, facsimiles and/or mechanical reproductions are not permitted and will be disqualified. Each entrant may submit as many entries as they wish, one hole and location per entry.
The decisions of Organizer and the judges in selecting the winners and in all matters relating to the Competition are final and binding. The winning designs and identity of the winners may be announced in the December 2010 issue of Golf Digest.
Ownership Rights in Submissions; Originality; License Grant: By submitting a hole design in the Competition (the "Submission"), you represent and warrant that (1) the Submission (which includes the models, images, video, and/or text submitted with the design) is your original work and you are the sole and exclusive owner and rights holder of the Submission; (2) you have not entered into or become subject to any contract, agreement or understanding that conflicts with your ability to enter into this legally binding agreement and convey the rights set forth herein; and (3) the Submission shall not infringe any third party proprietary, intellectual property or other rights, including, without limitation, copyright, trademark, patent, trade secret or confidentiality obligation. Your entry must not have won a prize in any other competition or have been previously published or sold. By submitting a Submission, you grant to Golf Digest, its affiliates, its respective successors and assigns, and others they may authorize, a non-exclusive, unlimited, worldwide, perpetual, royalty-free license to publish, reproduce, display, transmit, distribute, adapt, make derivative works of, and otherwise use your Submission, in any media now known or not yet existing, including but not limited to the golfdigest.com website and other Golf Digest-sponsored Web pages for any and all purposes, including for advertising and promotional purposes. You hereby acknowledge that you shall not be entitled to any compensation for any use of your Submission by Sponsor.
Qualified entries will be judged on a variety of qualities, including: All entries will be judged on or about September 1, 2010 (the "Judging Date") by a panel of judges comprising 4-6 architects and Golf Digest Architecture Editor Ron Whitten. The judges will score entries based on the following criteria: Innovative hole design: The creativity, memorability and shot values of the hole (40%); Hole aesthetics: uniqueness and beauty of the hole in the setting chosen (25%); Quality of the presentation, including a one-page written explanation of your site choice and your hole design (25%); Fitness and applicability of the hole to its setting (10%): the way the hole fits into the site chosen. The entry with the highest overall score will be declared the potential winner (in the event of a tie, the entry with the higher score in the Innovative hole design criteria will prevail). Any potential winner will be notified by mail, email and/or telephone. If a potential winner: (i) cannot be contacted; (ii) does not respond within five (5) days from the date the Sponsor first tries to notify him/her; (iii) fails to return the Affidavit and Release; (iv) refuses the prize; and/or (v) the prize or prize notification is returned as undeliverable, such potential winner forfeits all rights to win the Promotion or receive the prize, and an alternate potential winner may be selected. Upon contacting a potential winner and determining that he/she has met all eligibility requirements of the Promotion, including without limitation the execution of required waivers, publicity and liability releases and disclaimers, such individual will be declared the "winner" of the Promotion. Prizes: The prize is one (1) coach airfare ticket from the major commercial airport nearest winner's primary residence in the U.S. to a destination in the U.S. to be determined by Sponsor and/or Pete Dye, one (1) standard hotel room (single-occupancy) for two (2) nights at a hotel selected by Sponsor, up to five (5) meals, (not to exceed $50 per meal) and the opportunity to meet and, if possible, play golf with architect Pete Dye. Sponsor may, at its discretion, have the winning hole made into a virtual hole, playable on golfdigest.com and may, at its discretion, publish a feature about the winning entry in the December issue of Golf Digest. The approximate retail value of the prize is $2,500, depending on exact itinerary. If a minor wins, airfare, lodging and meals for a guardian will be provided. In such a case, retail value would be approximately $5,000. Actual value may vary based on fluctuations in price for airfare and/or accommodations, and distance between departure and destination. Ground transportation, meals not listed above, in-room or other personal charges at lodging (e.g., mini-bar, movies), telephone calls, gratuities, incidentals, and all other expenses are not included. Winner must be available to coincide with Pete Dye's availability otherwise winner forfeits that portion of the prize. Sponsor will attempt to accommodate winner's preferred itinerary, but all specifics thereof will be at Sponsor's sole discretion. If, in the sole judgment of Sponsor, air travel is not required due to winner's proximity to prize location, ground transportation may be substituted for roundtrip air travel.
